It is not unusual for me to wander around to places with cases in my hands (especially so when I have anywhere to walk).  Usually I find myself reading habeas cases.  There are a couple reasons for this: (1) I generally  find the area of law fascinating because of the interactions between criminal law, the constitution, and (to quote Hugo Black) "Our Federalism" and (2) occasionally you read a really thought provoking fact-pattern or analysis which makes you reconsider things.&lt;br /&gt;&lt;br /&gt;The other day I read &lt;em&gt;Campbell v. Wood&lt;/em&gt;, 18 F.3d 662 (9th Cir. 1994), where the Ninth Circuit voted 6-5 en banc that hanging was not cruel and unusual punishment.  I thought the majority opinion did not make sense (in that it focused almost myopically upon unnecessary pain, rather than any of the other factors one uses).  Reinhart's dissent was pretty masterful, concluding ultimately that hanging is "savage and barbaric" and therefore barred by the 8th Amendment.  &lt;br /&gt;&lt;br /&gt;Reinhart's dissent got me thinking about the myth of the quick and painless execution and the reality that, to the extent we know anything, we know that any of the execution methods we currently utilize may not be as painfree as they once were.  &lt;br /&gt;&lt;br /&gt;For instance, there is much litigation over the lethal injection "cocktail" which everyone has always assumed was like going to sleep.  &lt;em&gt;See &lt;/em&gt;&lt;a href="http://www.supremecourtus.gov/opinions/05pdf/05-8794.pdf"&gt;Hill v. McDonough&lt;/a&gt;.  It is possible that the chemicals used only freeze the muscles, thereby making everyone else unaware that the condemnee is actually in searing, burning pain.  &lt;br /&gt;&lt;br /&gt;Similarly, other methods of execution have been held to be cruel and unusual in the last decade because they impose to great a risk of painful suffering.  &lt;em&gt;See Fierro v. Gomez&lt;/em&gt;, 865 F.Supp. 1387 (N.D. Cal. 1994) &lt;em&gt;aff'd&lt;/em&gt;, 77 F.3d 301 (9th Cir. 1996) (lethal gas); &lt;em&gt;&lt;a href="http://www.appeals.courts.state.ga.us/opinions/index.cgi"&gt;State v. Dawson&lt;/a&gt;&lt;/em&gt;, 274 Ga. 327 (2001) (electrocution).  Others are still in bounds.  &lt;em&gt;See Campbell&lt;/em&gt;, 18 F.3d 662 (hanging); &lt;a href="http://caselaw.lp.findlaw.com/cgi-bin/getcase.pl?navby=volpage&amp;court=us&amp;vol=99&amp;page=136"&gt;&lt;em&gt;Wilkerson v. Utah&lt;/em&gt;&lt;/a&gt;, 99 U.S. 130 (1878) (firing squad).  And, certainly, many other forms of execution are unacceptable from almost all perspectives.  &lt;em&gt;See &lt;a href="http://caselaw.lp.findlaw.com/scripts/getcase.pl?navby=search&amp;court=US&amp;case=/us/471/1080.html"&gt;Glass v. Louisiana&lt;/a&gt;&lt;/em&gt;, 471 U.S. 1080, 1084-85 (1985) (Brennan, J., dissenting from denial of certiorari) ("Thus in explaining the obvious unconstitutionality of such ancient practices as disembowelling while alive, drawing and quartering, public dissection, burning alive at the stake, crucifixion, and breaking at the wheel, the Court has emphasized that the Eighth Amendment forbids 'inhuman and barbarous' methods of execution that go at all beyond 'the mere extinguishment of life' and cause 'torture or a lingering death' . . . [as well as] 'mutilation' and 'distortion' of the condemned prisoner's body.")&lt;br /&gt;&lt;br /&gt;So, to get to my point (I know, finally), I believe I have come to the conclusion that capital punishment cannot be constitutionally imposed because (1) every time a new "humane" method is arrived at (electrocution, gas, lethal injection), that method is eventually shown to bring with it the substantial risk of pain to the inmate and (2) the only methods which guarantee a [probably) painless death (guillotine, for example) are completely incompatible with anything resembling our modern standards of decency (but maybe &lt;a href="http://www.theforbiddenknowledge.com/hardtruth/georgia_bill_guillotine.htm"&gt;not&lt;/a&gt;--though I doubt the accuracy of this report).  Furthermore, I am also deeply troubled by the inability to measure exactly what these methods of execution do to the condemnee; we can hypothesize all we want, but we just don't know (see the debate about lethal injection, as well as the &lt;em&gt;Fierro &lt;/em&gt;court's discussion about the differences in the scientific community about the effects of cyanide gas).  &lt;br /&gt;&lt;br /&gt;This new outlook differs significantly from my previous position that the death penalty was conceptually ok, but given the uneven and halting application of it, should be banned until it could be "perfected" (truly a cop-out, I admit).  I suppose there is some wiggle room in my theory for a new method which guaranteed a painless execution, but frankly, I am not seeing it, given the twin poles I described above (the ultimately inhumane methods of standard execution bounded by a limit on what we can do to a person's body).  &lt;br /&gt;&lt;br /&gt;Finally, I understand there to be a sentiment out there, expressed succinctly by a Justice of the &lt;a href="http://www.oscn.net/applications/oscn/DeliverDocument.asp?CiteID=446506"&gt;Oklahoma Supreme Court&lt;/a&gt;, that the condemnee's &lt;blockquote&gt; request to be spared the imposition of his legally imposed punishment because it might cause him to suffer or experience pain unpersuasive (and rather ironic) as his murderous acts have been the cause of the ultimate pain and suffering for the victim and her family.&lt;/blockquote&gt;  &lt;br /&gt;This is facile analysis--we as society are supposed to hold the moral high ground.  There is no moral equivalance between us and murderers. I still like them both, but at this point I'm firmly rooting for Miami for one reason: Dallas' strategy is based entirely on fouling.  Maybe it's a good strategy, maybe it's not (based on Miami being up 3-2 I lean towards not), but regardless it's a shitty way to try to win.  It's just pathetic to see Mavs groping Shaq every time he gets close to the basket (even when Shaq doesn't have the ball!).  I mean, Shaq is so much better than anyone that could defend him that they'll happily give like 15 fouls a game on him alone?  It's just pathetic.  &lt;br /&gt;&lt;br /&gt;Further, when your strategy is based entirely on fouling, then you can't complain about getting called for fouls.  You adopted the plan - if the fact that you're intentionally making a huge number of fouls sort of conditions the refs to call you for other borderline fouls that's your own fault.  Play like a scared little wimp, and you'll get treated like a scared little wimp.    &lt;br /&gt;&lt;br /&gt;2) Dwayne Wade is no Michael Jordan (yet, anyway), but he's playing like him in this series.  He's just awesome.  And unlike Kobe, he can actually hit the big shot.&lt;br /&gt;&lt;br /&gt;3) I think I'm going to start watching soccer more often.  I watched Brazil beat &lt;br /&gt;Australia yesterday and it was awesome. I'm new to basketball and unlike Hockey, which has a reasonable start time, the NBA finals start at like 8:30 or 9, so it is really hard to blog afterwards. Then the Heat lost game 2 and I thought, well good thing I did not post anything because down 2-0 and playing still playing like shit I would be wrong. Well, the Heat won last night in overtime. Wade got the ball with about 8 seconds left and drove to the net to get the foul. With 1.9 seconds left he hit the first one to tie it and after some confusion over a timeout call (which if you saw the game I thought was a brilliant strategy to try to ice Wade by pretending that you did not want to call the timeout) the hit the second FT like he was in practice. so I'll Say it again, Heat in 6!&lt;br /&gt;NHL I have been saying Carolina in 7. For this one I have witnesses. Game 7 is tonight  at Carolina, but they have wasted their 3-1 series lead and if they lose, it will be one of the biggest collapses in NHL history...&lt;br /&gt;Not as bad as Mickelson yesterday. However, we should have been up a man for half the game and those two red cards were some of the crapiest calls in all of sports (that I have seen)  My prediction? without the knock-out round set yet it is hard to pick, but I'm going with England. They end by stating that the battle for the "libertarian center" has begun.&lt;br /&gt;&lt;br /&gt;I meant to post on this a little while ago when the daily kos had a post on "libertarian democrats."  I thought kos' description was a little off, btw.  but it's a useful start.  &lt;br /&gt;&lt;br /&gt;BJ and Jason I think have both heard my rant on this (Marc has been spared so far), but I think the concept of a libertarian center is essentially correct.  Most people just want to be left alone by the government.  These aren't hardcore people, and they would never describe themselves as libertarians, but they get queezy about excessive government.  The differences are where the feel the gov should get involved, and how effective or ineffective it is when it does. Each time, I play at least well enough to waste a lot of time, and last night I was about 4 spots from finishing in the money (I could taste that 5 bucks!).  So, for my own personal reference next time I'm playing, I'm gonna post some of my lessons learned (sorry for taking up space here).  &lt;br /&gt;&lt;br /&gt;1) Stay Disciplined.  When that little voice in your head is saying, "Fuck it," that means I should fold.  So for the foreseeable future, when playing poker "fuck" = "fold".&lt;br /&gt;I've found that typically I always have a hand where my brain just shuts off.  Sometimes this is preceded by the "fuck it", which we now know means "fold it".  Other times, you've just been playing for a while and eventually your brain just isn't working right.  Just try to avoid that.  If you make a bet and something in your head says, "I shouldn't have done that," don't compound the damage by trying to bet your way out.   &lt;br /&gt;&lt;br /&gt;2) When you're not getting any good hands (like last night when I was just getting absolute shit), then of course you just have take or steal pots when you can.  However, do not get carried away!  If 500 is good enough to take the pot, don't bet 1000.  Cause if somebody else actually has something, it's better to lose 500 than to lose a 1000.  And if somebody re-raises that 500, don't be ashamed to fold.  You took your shot, and it didn't work. Pleasant everyone always says, "we need some independent book stores. I say, "fuck book stores!"  &lt;br /&gt;&lt;br /&gt;Now these neighbors want small independent book stores, not places like Borders, but essentially they are all the same, and they all suck. I keep a list of books I'm interested in my amazon account, and this weekend I downloaded it to my Palm and went to a book store that a contributor of this very site use to work. All I wanted was one of the 8-10 books on my list. I picked Borders because, unlike Barnes and Noble, you can use the computer search yourself. Try searching for a history book at B&amp;N that does not fit into one of their neat self-created categories of US, European, African, etc. So I go up to the computer at Borders, and title search, "Escape from Hunger and Premature Death": ENTER. The first 5 results are on Premature Ejaculation, the next two are on Premature birth. I search again using the author's name with the title and get the right book... it is out of stock.&lt;br /&gt;My second and third choices are listed as in stock so I go to find them, the first one is "Wisdom of Crowds" and in the Business and management section, which is subdivided into no less the 4 subsections, none of which actually had my book as promised. Lastly, I went over to the Humor section which had my third choice, "Area of my Expertise" a long with Al Frankin's political books, which I thought should be where Ann Coutler's books go (just because he uses humor instead of fiction, doesn't mean he should be cast out of the Current affairs Section). Maybe I'm giving them too much credit, maybe they really did not do that much. I know A's dad has their move and book on the issue, so it at least gave fodder to the Rushians and others. But here on the one hand we have Kerry, where they succeeded in making a national question over weather or not Kerry was shot at in Vietnam. A US Serviceman shot at? In Vietnam? Impossible! Perhaps I'm wrong here but that would be like questioning if someone landing at D-Day (61 years ago today) got his boots wet. &lt;br /&gt;I'm surprised that more servicemen did not stand up for Kerry. He spoke out against a war that is now seen as a mistake, but he did fight. I can somewhat understand the point related to that, eventhough they are wrong. I think my "rules about war" are pretty universal and speak volumes here. &lt;br /&gt;Rule 1: I never want to fight a war, and those people who think they do are wrong&lt;br /&gt;Rule 2: We respect soldiers because rule number 1 is true&lt;br /&gt;Rule 3: War is the worst thing, and people that fight them are really the only ones that will truly know what it is like. &lt;br /&gt;From this Kerry was just saying that Vietnam sucked, right? People say his testimony "got soldiers killed." and that is just stupid bullshit.&lt;br /&gt;In a vacuum this doesn't make sense, but when viewed in the real world of the 2004 election it is flat out form another planet. It is such a complex story that seemingly has passed under the radar despite the presence of 1,000 of lawyers at every level every step of the way. Yet some how the RNC was able to pull it off, the same people that served up Harriet Meirs as a "good idea"? The truth is in the footnotes, a bunch of small town reports that never amounted to much in the public eye along with books that site articles and what not. I'm only done the first part of the story, but it seems like bunk to me, as much as I wish it the outcome was different. &lt;br /&gt;&lt;br /&gt;In the absence of Woodward and Bernstein-like work, I see this as nothing more then an extended book report on a number of sources that, rightfully so, have never created a national stir. &lt;br /&gt;&lt;br /&gt;To add for future discussion:&lt;br /&gt;1. There are irregularities in every election, on both sides&lt;br /&gt;2. Is it really so hard to believe that Bush won? Both sides, I feel are guilty of denying the facts of the situation. On the oneside people think we can stop or slow it, on the other they think there is little or no problem. &lt;br /&gt;As I see it we need to start discussing and acting on how we will deal with the millions of people who will be living below sea level in 100 years. type='text'>Does Saddam Really Deserve to be on Trial?</title><content type='html'>Perhaps the best option for the US would be to see if Saddam would be willing to work out a plea bargain to avoid jail time in exchange for heading out military occupation in Iraq. It seems he alone was capable of something the US has not been able to do -bring peace to Iraq. In the coming weeks we will officially "lose" Iraq &lt;a href="http://www.cnn.com/2006/WORLD/meast/05/29/marines.haditha/index.html"&gt;based on this news&lt;/a&gt; All the hard work, money, lose of values, and lost of life will added up to nothing. And with nothing to show for it, all the "good things" that people, mostly administration apologists, will also be lost. No number of bridges or healthcare facilities built (or contracted to be built) or children saved from burning buildings will matter when the weight of the country is against us. &lt;br /&gt;&lt;br /&gt;Perhaps the Iraqi people are ungovernible except by the most powerful and oppressive kinds of rule? Even though we tried Saddamian tactics, they were half hearted. I guess you can argue that we did not try them hard enough, that had we had one more torture prison or a few more civilian shoot ups, everything would have turned out better. I guess the large numbers of Spanish language newspapers, Spanish language television, Spanish speaking politicians, and majority Spanish speaking communities and neighborhoods are all daft in some way, unable or unserious enough to cover and educate themselves about important issues.&lt;br /&gt;&lt;br /&gt;This particular op-ed is focused on the concept of bilingual ballots (which today are required), but he had another one last week about how immigrants should all speak English anyway.  This would probably be beneficial to them - and judging by the fact that 80 % of 3nd generation immigrants use English as their primary language immigrants apparently see the value also.  &lt;br /&gt;&lt;br /&gt;In the article he mentions the ridiculousness of statements by Harry Reid that the language bill was in some ways racist. I'm in the minority here, most people would not give up the taste of their favorite food, or the social aspect of eating for the control and reliability I want. Personally, I think both are over-rated, and I love food. I can be social over other things besides food, and I could still go out for others to eat. Eating takes up time, it has to be planned around, in many ways it is anti social, we just do the best we can with it. Many of my favorite foods are gross. Have you ever de-veined a shrimp... it is not a vein. Furthermore, we don't eat to taste, we eat for nutrition. Taste has, or will soon become, a primitive relic of when we were not smart enough to know which foods were safe and which ones were not.&lt;br /&gt;Anway, for lunch I often opt from frozen foods; Cheap, easy and efficient. Taste, one of most people's main factors in the food they select does not usually play into my lunch selection. I go to the frozen food section, look first at the nutrition guide, then at the instructions. Anything that has more then 3 instructions is passed up. No stirring half way though, no 50% power settings Open, cook, eat is it.&lt;br /&gt;&lt;br /&gt;But today I had Health Choice's Baja Chicken and it was one of the worst things ever. Who knew bland could taste so bad? The market has built in an "Iran going to shit" premium.  One way to lower that cost would be for us to engage with Iran (as Iran has repeatedly asked for).  Doesn't mean we have to give in on anything, but if we lowered the rhetoric and at least pretended like we could come to an amicable agreement, oil prices would lower and gas prices would lower as well.&lt;br /&gt;&lt;br /&gt;In fact, it occured to me the other day that one rationale Iran has for pursuing this nuclear weapon is the increased oil revenue they've been getting.  I read an article somewhere (can't remember where) which talked about the consequences of Iran shutting off oil flow.  Mostly bad for Iran.  In the middle of the article, though, they mentioned that Iran's oil receipts have gone through the roof since the beginning of this nuclear issue.  Therefore, they have an interest in prolonging animosity with the US so long as it doesn't escalate into sanctions or an attack.  &lt;br /&gt;&lt;br /&gt;So when anyone says there's nothing this administration can do about gas prices, they're wrong.  One very simple thing they can do is accept Iran's offer to talk and stop acting as though we'll invade.  After all, Iran is at least like 3 years from getting the nukes.  &lt;br /&gt;&lt;br /&gt;Am I missing something? Fundamentally, these programs (data collection or social) are run by a bunch of careless schmucks. Currently the Dpt. of Education is thinking about developing a tracking system for all students in the US. This will include race, gender, field of study, transfer information, loan and funding information, etc. Most of which can easily be tied to other data to create some kind of information stalker-esque db.&lt;br /&gt;For those who say, "if you haven't done anything wrong you have nothing to worry about" this is my number one argument. In addition to raising the pay of future legislatures, they also (in order to get around the state constitution which prohibited a legislature from raising its own salary) granted themselves "unvouchered expenses" to cover the amount of the pay raise.  These were unexpenses which a legislator could claim without a receipt, up to a certain total (which, oddly enough, coincided exactly with what the amount of the pay raise would have been).  The governer signed it.  (A good primer on this can be found &lt;a href="http://en.wikipedia.org/wiki/Pennsylvania_General_Assembly"&gt;here&lt;/a&gt;).  &lt;br /&gt;&lt;br /&gt;The whole thing set off a giant shitstorm which resulted in a hasty repeal of the whole debacle in November 2005.  In addition, a state supreme court Justice lost his retention vote for the first time in history (another Justice narrowly was retained).  Numerous challengers to state legislators also came out of the woodwork to run for office (the strongest opposition was Western Pa, followed by Central Pa.  Philadelphia and the surrounding counties did not care--given the everyday corruption we live with, this seemed like small potatoes).  &lt;br /&gt;&lt;br /&gt;Well, the primary was last Tuesday and &lt;strong&gt;&lt;a href="http://www.pittsburghlive.com/x/pittsburghtrib/news/cityregion/s_454252.html"&gt;seventeen&lt;/a&gt; &lt;/strong&gt;incumbents lost their primary reelection bids, including the President Pro Tem of the Senate and the Senate Majority Leader. Obviously, the intent was to say hey, Bush/Cheney are hypocrites playing into weirdo views about homosexuality which they know aren't true, even at the expense of their children.  Hardhitting and personal?  Yes.  But is it really as bad as, say, backing a gay-baiting constitutional amendment to win an election?  Not quite.    &lt;br /&gt;&lt;br /&gt;So you've got this huge outrage.  It seems to me, though, that the folks who were outraged about it must have felt that a significant number of the people most likely to vote for Bush/Cheney are so homophobic that learning that Cheney's daughter was a lesbian would cause them not to vote.  So it was outrageous because of the bigoted views of many of Bush/Cheney's supporters.  Somehow that's Kerry's problem?  I don't get it.  &lt;br /&gt;&lt;br /&gt;Finally, on the actual question of whether homosexuality is a choice.  I contend that those who feel homosexuality is a choice, and that feel that homosexuality is wrong and should be stamped out because it's dangerous, must themselves be closeted homosexuals.  If you think it's a choice, then why would you be so concerned about it spreading unless you felt there something appealing about it? not because I want to point out what a great comeback the Yankees made (although holy shit coming back from 9 runs down is pretty good), but to complain about a new category the brains in the sports announcing industry have come up with.  I started hearing ESPN use the phrase "walkoff home run" I think last year, and I have no idea why.  It looks like they're trying to get the term to be used as the regular description of what we normally would simply call a "home run".  Apparently, they feel this is needed to differentiate from regular home runs from "inside-the-park home runs".  And so now Sports Illustrated looks to be following their example.   &lt;br /&gt;&lt;br /&gt;What an idiotic idea.  99% of home runs are of the regular hitting the ball over the fence variety.  Typically, you refer to the norm with the normal description, and refer to the bizarre with a modified description.  That's exactly what we have here.  The norm is hitting the ball over the fence, thus you refer to that event as hitting a home run.  The bizarre is getting around all the bases while the ball stays in play, thus you refer to that with the modified "inside the park home run."  Therefore, adding "walkoff" before "home run" is unnecessary.  And it's not even beneficial in any way.  "Home run" is shorter and easier to say than "walkoff home run." Pretty interesting article - anti-spam security group rounded up over 500,000 customers and sent 500,000 emails to a variety of spammers at the same time requesting that they stop spamming.  This interfered with a lot of the spammers, so some of them gave in.  But one of the spammers counter-attacked, shutting down the spam security firm and creating a lot of internet havoc.  That, itself, may or may not be illegal.  But the icing on the cake was that spammer threatening to start sending viruses to all 500,000 customers. Of course, the bombing over Pan Am 103 over Lockerbie, Scotland in 1988 was a terrorist act perpetrated by the Libyan government.  A lot of people, including at least &lt;a href="http://en.wikipedia.org/wiki/Pan_Am_Flight_103"&gt;128 Americans&lt;/a&gt;, were killed in this bombing.  Of all of Bush's simplistic black/whitism, you would think terrorist=bad would be an easy thing to remember.  &lt;br /&gt;&lt;br /&gt;So, I guess the lesson of &lt;a href="http://www.cnn.com/2006/US/05/15/libya/index.html"&gt;this&lt;/a&gt; is that you can order the murder of American citizens and terrorist attacks around the world, but as long as so hang on to power long enough to gradually renounce murder and terrorism (at least internationally), you will be accepted with open arms. I find this inexcusable, X-men fan or not (which I really am not) comic book fan or not( on the comic book scale I was at the low end) the X-men movies are just awesome, and I can speak for myself and at least one other contributed to this blog that X-men 3 is on 'the list'. &lt;br /&gt;&lt;br /&gt;However, I just watched the trailer for the new Superman (what only one super hero? X-men has like 1,000s) and I might be looking forward to that even more. The thing about Superman is the movies were never really about Superman. Superman has no spice, he is a boy scout. He never even really likes to kill the bad guys (contrast this to Wolverine when the commandos show up at the mansion) Superman is always about the bad guys. Hackman as Lex Luther, or Richard Prior in Superman 3 (who  got more money then Reeves) And everyone remembers General Zod. So who is the bad guy in Superman returns? It is still Lex Luther, but this time played by Kevin Spacey. I think this is beyond perfect. Remember he played Dr. Evil in Goldmember the bad guy in Se7en and Usual Suspects. He is good as the bad guy, cold and crazy but still human and believable. I"m sure there is something about if the government requests such records as part of a criminal investigation then the contract says that it will happen, but what about this? Or what if I use Qwest, the major company that didn't comply with the NSA request, will the data from the other companies include call from there services made to my number? Then his spokewoman &lt;a href="http://dallas.bizjournals.com/dallas/stories/2006/05/08/daily19.html"&gt;described the contract to which he was referring&lt;/a&gt; (scroll to bottom of story to see what the spokewoman said on May 3, before changing her story).&lt;br /&gt;&lt;br /&gt;It's really weird that you'd tell a story, then later further detail how and to whom it happened, and then later claim that it was all made up.
